Terms and Conditions

Hello, and welcome to our Terms and Conditions of Use. These are important and affect your legal rights, so please read them and our other terms referenced in this document carefully.

The following terms and conditions set out the basis on which all dives, training, courses, dive bookings, merchandise and services sale are sold and/or made by Davy Jones Diving, ("We", "Us", "Our", "The Company"), to and/or with the purchaser, ("You", "Your", "Candidates", "Students", "Divers"), from our websites ("the Site"), by telephone,email, Whatsapp or other socila media, or in person in the centre.

These terms and conditions, together with our Privacy Policy and any order form or payment instructions comprise the whole agreement between You and Us in relation to each sale, for example, course or dive booking, we accept from you.

By making a booking via the site, over the telephone, email other electronic messages (eg SMS, Chat, Whatsapp) or in person you agree to be bound by these terms and conditions.

By making a booking you acknowledge that you have not relied on any statement, warranty or representation other than those which are made in these terms and conditions, our safe diving practices and our Privacy Policy, any order form or any payment instructions.

Course Bookings

1.1. All divers listed on a course booking will be included in the booking and the charges will be applied for all spaces booked.

1.2. A deposit may be charged at the time of the booking to confirm the booking.

Safety is a prime focus so candidates must meet all minimum standards for their chosen course, both as set by our training agencies (e.g. PADI) and set by any governmental or regulatory agencies. Candidates who do not meet the standards may be denied the option to book a course, or if they arrive for the course and do not meet the requirements, may be denied training.

1.3. Candidates agree to abide by the instructions, rules and decisions of Davy Jones Diving, its staff and subcontractors in all diver-training matters.

1.4. Candidates may not participate in diving activities without a satisfactorily completed medical statement and a statement of understanding and assumption of risk. Any delays caused to the course by failure to complete these administrative and medical requirements may be chargeable at the current missed session rate.

1.5. Any non-attendance of scheduled sessions may be charged at the current missed session rate.

1.6. If Customers fail to meet the performance requirements on any dive or knowledge development session, at the sole discretion of the instructor, Davy Jones Diving reserves the right to charge for repeating that dive or session, the rate for this will be based on the current missed session rate at that time and depend on the nature of the dive or session in question.

1.7. Neither Davy Jones Diving, its employees nor its contractors can be held responsible for damage to, or loss of, any personal equipment caused prior to, during or after any diving activities.

1.8. Course Cancellations made by you:

You are entitled to cancel your course at any point. All cancellations can be made by the following methods:

1) Contacting us by Text message or Whatsapp message.

2) Sending an email to divenow@davyjonesdiving.com.

Cancellation will take effect from the day this notice is received and the receipt will be confirmed in writing via text message or email. We reserve the right to make Cancellation charges as a percentage of the total course price depend on the number of days before the course on which notice of cancellation was received.

1.9. Changes made by us:

It is unlikely that we will have to make any substantial changes to your course arrangements. Occasionally, we may have to make small changes (for example, a classroom change may be necessary or Dive Site for training) and we reserve the right to do so at any time.

1.10. We also reserve the right to cancel your course arrangements in exceptional conditions. For example, in the event of instructor illness, or severe weather or sea conditions, or local land based civil emergencies.

1.11. Candidates will need to meet the PADI performance requirements for their course in order to be awarded the final certification. If extra time or sessions are required to achieve any of the published performance requirements an additional fee may be charged. If Candidates cannot meet the requirements then PADI standards mean we cannot award the qualification, however a course training fee will still need to be paid.

Dive Trips Bookings

2.0. Safety is our major concern so all divers must read and follow our Safe Diving Practices, provide evidence of their diving qualification and insurance, and comply with any PADI or regulatory requirements.

2.1. All divers listed on a dive booking will be included in the booking, and the charges will be applied for all spaces booked.

2.2. A deposit may be charged at the time of the booking to confirm the booking.

2.3. Once we depart the Dive Centre for a dive, the dive will be considered to be taking place.

2.4. The Dive Centre reserves the right to change dive sites or vessels without notice, due to weather, sea conditions, safety, suitability or any other reason.

2.5. Dive Trip Cancellations made by you:

You are entitled to cancel your dive trip at any point. All cancellations can be made by the following methods:

1) Contacting us by Text message or Whatsapp message.

2) Sending an email to divenow@davyjonesdiving.com.

Cancellation will take effect from the day this notice is received and the receipt will be confirmed in writing via text message or email.

We reserve the right to make cancellation charges as a percentage of the total dive trip price depend on the number of days before the dive trip on which notice of cancellation was received.

2.6. Changes made by us:

It is unlikely that we will have to make any significant changes to your dive trip arrangements. Occasionally, we may have to make changes (for example, a port or dive site change may be necessary) and we reserve the right to do so at any time.

2.7. As payments are normally completed at the end of the dive programme, you will be charged for the actual number of dives completed, not the planned number of dives.

2.8. The centre reserves the right to refuse divers to dive if in the opinion of the Dive Centre the diver is not suitable for the chosen dive for any reason. In this case, the reason will be explained.

2.9. In all matters relating to the dive trip booking the Dive Centre’s decision is final. Divers should follow any safety instructions given by the staff.

2.10 The centre decision on any diving matters is final.

-2.11. The centre reserves the right to refuse divers to dive if in the opinion of the Dive Centre the diver is not suitable for the chosen dive for any reason. In this case, the reason will be explained.

3. Payment options and Cancellations:

3.1 We accept payment in Euros in cash, or cards from Visa, Mastercard, Switch/Maestro (but not American Express or Diners Cards). We do not accept Travellers Cheques, US dollars, Bitcoin, or Sterling cash.

3.2 You will normally settle your account on the invoice date at the end of your visit. We may ask guests taking courses or who are hiring full equipment, or large group bookings to either pay a deposit or complete a credit card authorisation slip at the start of the diving.

3.3 If you are unhappy with your account at the end of your diving, you should discuss the issue with us on the day we prepare the account, and we will aim to find an amicable solution. If the issue is not resolved then a formal request for a lower value must be submitted in writing within 10 days of the invoice date stating the reasons for the request.

3.4 Accounts should be settled within three weeks of the invoice date. Failure to settle an account by this date will be regarded as a default on the payment and we will follow appropriate debt recovery actions, which could include the addition of interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 and debt recovery charges to unpaid amounts.

3.5 If your package includes a discount this will be shown on the confirmation of booking and it is vital that you bring this confirmation with you otherwise you may be charged the full price.

3.6 Gift vouchers and pre-payment vouchers issued by Davy Jones Diving are valid for 12 months from the date of issue, and are only valid for the person named on the voucher. Gift Vouchers cannot be redeemed for cash, and Gift Vouchers can only be used once.

3.7 Should you need to cancel your booking at any time before or after your arrival in resort (for any reason), please phone us immediately on (00 34 ) 699 721 584 if for the same day, or send an email or call for longer notice periods.

4.0 General and Other

4.1. Davy Jones Diving accepts NO LIABILITY for loss or damage to personal property including diving equipment. Any equipment left in our vehicles during dives, or in the dive centre during dives or overnight or during transport is at the owner's risk. A customer safe is available in the dive centre.

4.2. Divers and students using Davy Jones Diving equipment for any course are responsible for that equipment and may be charged for any loss or damage howsoever caused.

4.3. We reserve the right to change these terms and conditions at any time.

4.4. IMPORTANT NOTE: Refunds or any compensation payments do not apply if we reschedule or cancel your course or dive trip due to circumstances beyond our control (force majeure). We can reschedule or cancel your course in the following circumstances: war, the threat of war, riots, civil strife or terrorist activity, industrial disputes, natural or nuclear disasters, fire, medical issues such as viruses epidemics or pandemics, technical problems with transport, technical problems in general, airport closures, bad weather or sea conditions, or if instructed to suspend activities by the Guardia Civil, or other government bodies, and similar events beyond our control.

4.5 All Bookings are subject to availability.

4.6 The maximum amount of refund or compensation payable is limited to the amount that has already been paid.

5.Spanish Diving Insurance

5.1 We have full public liability insurance, however you should arrange adequate personal insurance cover for diving activities, and courses. This is required by Real Decreto 550/2020 in Spain and must include cover for Hyperbaric treatments, accidents as well as third party liability insurance. This insurance is included in introductory courses but not the PADI Advanced or Speciality courses or higher. You should note that 1) many travel insurance policies exclude cover for certain sporting activities, or place limits on their aplicability. 2) The BSAC diver insurance ONLY covers Third Party Liability, and does not cover diving accidents. You should carefully check the terms of any proposed insurance policy to ensure that it meets these requirements. Suitable insurance can be arranged on the day in the dive centre.
